1) Acceptance of these Terms
By accessing or using the Site, downloading materials, or subscribing to the newsletter (together, the “Services”), you agree to these Terms of Service (“Terms”) and to our [Privacy Policy]. If you do not agree, do not use the Services.
2) Who may use the Services
The Services are intended for a general audience and are not directed to children under 13 (or under 16 in the EU/UK). If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
3) Content & intellectual property
Ownership. All text, images, files, logos, and design on the Site are owned by Louis-Charles Fortier or licensed to us and are protected by copyright and other laws.
Personal, non-commercial license. You may view pages and download publicly available files for your personal, non-commercial use.
What you may not do. You may not copy, republish, mirror, frame, scrape, data-mine, train AI models on, or commercially exploit the content without prior written permission.
Sharing & quotations. Linking is welcome. Short quotations with clear attribution and a link back to the original page are permitted.
4) Your submissions
Contact forms & email. If you send us messages or feedback, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and reproduce that content as needed to operate the Services and respond to you. You retain all ownership in your content.
Prohibited conduct. You agree not to: (a) violate law or others’ rights; (b) attempt to gain unauthorized access; (c) interfere with the Site’s operation; (d) upload malware; or (e) use the Services to send unsolicited or harassing content.
5) Third-party services
We rely on third-party providers (e.g., Squarespace for hosting/forms/analytics, Google Analytics, ConvertKit for newsletters). Those services may have their own terms and privacy policies; your use of them is subject to those terms. We are not responsible for third-party sites, content, or outages.
6) Downloads & external links
Any files you download from the Site are provided “as is.” External links are provided for convenience; we do not control or endorse third-party sites and are not responsible for their content, security, or availability.
7) No professional advice
The Site offers editorial content and opinions. It is not legal, financial, medical, or other professional advice. You should seek a qualified professional for advice tailored to your circumstances.
8) Privacy & cookies
Our handling of personal information (including cookies/analytics and newsletter data) is described in our Privacy Policy, which is incorporated by reference into these Terms.
9) Changes to the Services or Terms
We may update the Services and these Terms from time to time. Material changes will be signaled by updating the “Effective date” above. Continued use after changes means you accept the revised Terms.
10) Termination
We may suspend or terminate access to the Services (in whole or part) at any time, including if you violate these Terms or for operational/security reasons. Upon termination, Sections 3, 6, 7, 11–15 survive.
11) Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability. We do not warrant that the Services will be uninterrupted, secure, error-free, or free of harmful components.
12) Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, or goodwill; or service interruption or system failure; arising out of or in connection with the Services or these Terms, even if advised of the possibility of such damages.
Where liability cannot be excluded, it is limited to CAD $100 in aggregate.
Consumer rights. Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws (including those of Québec, the EU/UK, or your local jurisdiction).
13) Indemnity
You agree to defend, indemnify, and hold harmless Louis-Charles Fortier from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services or your violation of these Terms or applicable law.
14) Copyright complaints
If you believe content on the Site infringes your copyright, email lcf@louischarlesfortier.com with: (a) your contact details; (b) a description and location (URL) of the material; (c) a statement that you have a good-faith belief the use is not authorized; and (d) a statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act. We will respond as appropriate under applicable law.
15) Governing law & disputes
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You and we agree to the exclusive jurisdiction of the courts located in Montréal, Québec, except that we may seek injunctive relief in any court of competent jurisdiction.
If you are a consumer in a jurisdiction that requires local venue, this clause does not deprive you of mandatory protections.
16) International use
The Services are controlled from Canada and may not be appropriate or available in all locations. You are responsible for compliance with local laws where you access the Services.
17) Miscellaneous
Entire agreement. These Terms + the Privacy Policy are the entire agreement between you and us regarding the Services.
Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a reorganization.
No waiver. A failure to enforce a provision is not a waiver.
Severability. If any provision is unenforceable, the remainder remains in effect.
Language. These Terms are provided in English. A French version may be provided; in case of discrepancy, the English version controls.
